It's a loan, and his contract has been extended by one year. According to DFL statutes, a loan can only be agreed on if the player has a contract outlasting the loan (§5 section 2).

So, have the DFL statutes been broken?

I've no idea how this is supposed to be consistent with the statutes. §5 Section 2, on page 7:

Über die Ausleihe ist eine schriftliche Vereinbarung zwischen dem Spieler und den
beiden betroffenen Clubs zu treffen. Die Ausleihe muss sich mindestens auf die Zeit
zwischen zwei Wechselperioden beziehen. Voraussetzung ist weiterhin, dass eine
vertragliche Bindung mit dem verleihenden Club nach dem Ende der Ausleihe
besteht.

I see the statues you linked are dated 2015. Is it possible that something has changed since?

The version that's available for download at the Bundesliga site is more recent, but the paragraph about the loans is the same.

I don't understand why it was allowed then. The way it should have been done is that Bayern mutually dissolved Badstuber's contract and he signed a short contract with Schalke. It would have effectively been the same thing.

About the loan thing: they might've agreed to just terminate the contract after the loan?!
